The Treasury waiver is a clock problem. H. R. 6968, the April 2022 law banning Russian fuel imports, is real and still on the books, but it has no fast enforcement mechanism. The executive waiver process exists precisely to create temporary exceptions, and the current license runs for six months.
The Tariff Precedent
Trump already showed how this works. In April 2025 he imposed sweeping tariffs on every country on Earth.
It was illegal. Ten months later the Supreme Court said so and struck them down.
By then the damage was done. The tariffs had operated for almost a year. The same logic applies here. Even if a court eventually rules that Trump abused executive waivers and violated H. R. 6968, the litigation will take months.
The six-month Treasury license will expire before any ruling lands. Russia will have sold its diesel. And proving abuse is not straightforward. The waiver mechanism is broad. A court would have to establish that the administration exceeded its authority under a law that was never designed for rapid congressional intervention.
Congress Will Not Move
The current Congress still has a Republican majority. If it had the votes and the will to block this immediately, it would have done so already.
The noise would not exist. It has not moved. It stays still.
The next Congress does not take office for months after the election. Even if Democrats win both chambers, they cannot act until the waiver has already run its course.
Lawsuits take longer than diesel shipments.
The Diesel May Never Reach America
Most people miss this part. The deal matters even if the fuel never enters a US port.
Russian diesel can flow to Brazil, Turkey, Africa, Asia. Those were the destinations before Russia imposed its own export ban in July. The Treasury waiver simply removes the American legal barrier. It creates a global market signal.
The point was never the diesel itself. The point is the precedent: Trump and Putin doing business behind the backs of Ukraine and Europe. The fuel is secondary. The arrangement is the story.
